1. GENERAL PROVISIONS
1.1 Use all reasonable endeavors to protect the interests of learners in connection with the acquisition of qualifications;
1.2. Take all reasonable steps to ensure compliance with applicable regulatory and legal requirements;
1.3. Comply with all laws and regulations relevant to its activities;
1.4. Always adhere to the Event Policy and Procedure;
1.5. MedLeech delivers Qualifications only at training/examination/assessment locations included in the Approved List, which may be added or removed in accordance with the provisions of the Agreement.
2. CONFLICT OF INTEREST.
2.1. Establish, maintain, and comply with a conflict of interest policy;
2.2. Identify and manage:
a) all relevant conflicts of interest
b) any scenario in which it is reasonably foreseeable that any such conflict of interest could arise in the future;
2.3. Take all reasonable steps to ensure that any conflict of interest associated with it will not have an Adverse Consequence.
3. RESOURCES
3.1. Maintain Personnel of an appropriate size and competence to deliver the Qualifications, including sufficient managerial and other resources to enable the effective and efficient delivery of the Qualifications;
3.2. Regularly monitor the resources required to deliver the Qualifications to learners.
4. MISCONDUCT AND MALADMINISTRATION
4.1. Take all reasonable steps to prevent any abuse or maladministration in the delivery of the Qualifications;
4.2. Take all reasonable steps to monitor risks and suspected cases of abuse or maladministration;
5. REGISTRATION, ASSESSMENT AND MODERATION.
5.1. Use all reasonable endeavours to ensure that the identity and information provided by learners upon registration is accurate and complete;
5.2. Register learners promptly upon enrolment;
5.3. Ensure that each learner undertaking a qualification is registered in a way that allows them to be clearly and unambiguously identified;
5.4. Take all reasonable steps to ensure that learners are fully informed of the requirements of their chosen qualifications, as set out in the relevant qualification specifications and guidance;
5.5. Provide learners with appropriate induction and support in accordance with MedLeech Policies;
5.6. Have mechanisms in place to enable recognition of prior learning, where relevant to the qualification and in accordance with the relevant MedLeech Policies;
5.7. Ensure that arrangements are in place to confirm learners' identity for each assessment;
5.8. Take all reasonable steps to ensure that:
a) assessments are conducted effectively and efficiently and in accordance with any qualifications and assessment criteria set out in MedLeech's Policies and Procedures or otherwise prescribed by MedLeech;
b) Any material produced by a student during an assessment is created by that student;
c) If an assessment is required to be completed under specific conditions, students complete it under those conditions (except where MedLeech's Policies and Procedures regarding equality and diversity policies and/or access arrangements, reasonable adjustments, and special considerations require otherwise);
d) The criteria by which student performance will be assessed are applied accurately and consistently;
5.9. Ensure that the security of assessment materials is maintained at all times and is not compromised in any way;
5.10. Take all reasonable steps to ensure that no person associated with or formerly associated with it discloses or causes to be disclosed any assessment or the content of any assessment materials where such information is confidential.
6. REVIEW, MONITORING, AND COMPLAINTS
6.1. All aspects of the delivery of Qualifications are monitored, reviewed, and at all times comply with the terms of the Agreement.
6.2. An effective and appropriate complaints and appeals procedure is in place in the interests of students, in accordance with the relevant MedLeech Policies and Procedures.
7. EQUALITY AND DIVERSITY
MedLeech complies with the requirements of the Equality Act 2010 (the "Equality Act").
7.1. Implement appropriate equality and diversity policies in relation to protected characteristics, covering unlawful discrimination and other actions prohibited by the Equality Act and/or any equivalent legislation in the territory. This includes preventing unlawful discrimination, directly or indirectly, on the grounds of disability, age, marriage and civil partnership, gender reassignment, pregnancy and maternity, race, religion or belief, gender, and sexual orientation;
7.2. Give due consideration to the need to eliminate unlawful "discrimination," "harassment,"
7.3. "victimization," and other conduct prohibited by the Equality Act; 4. Comply with MedLeech's Policy and Procedures on Equality and Diversity, Access, Reasonable Adjustments, and Special Considerations;
7.5. Regularly monitor and review compliance with the requirements of this clause;
7.6. Promptly notify MedLeech of:
a) any situation that becomes known that may disadvantage a Learner with a particular protected characteristic;
b) any complaints received about equality in the provision of qualifications. MedLeech may monitor and investigate any complaints or other notices relating to equality in the provision of qualifications.
8. ANTI-BRIBLE AND CORRUPTION
8.1. MedLeech complies with all applicable laws, regulations, and ordinances relating to anti-bribery and corruption, including, without limitation, the Bribery Act 2010 and any similar laws in the Territory.
9. DATA PROTECTION
9.1. "Data Protection Laws" means the Data Protection Act 1998 or the General Data Protection Regulation (EU) 2016/679 adopted by the European Parliament on 14 April 2016, as well as the Federal Law "On Combating Corruption" of 25 December 2008 No. 273-FZ in Russia, the Privacy and Electronic Communications (EC Directive) Regulations 2003 or the EU Privacy Regulations, whichever is in force in the United Kingdom at the relevant time; and all other applicable laws and regulations relating to the processing of Personal Data and privacy, including statutes and, where applicable, guidance and codes of practice issued by the relevant governmental or regulatory authority, all as amended, extended, restated, or replaced from time to time;
9.2. "Data Security Breach" means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, a student's Personal Data;
9.3. The terms "Personal Data," "Data Subject," "process," "processes," and "processing" have the meanings given to them in the Data Protection Act 1998 ("DPA") in the UK data protection laws.
10. STUDENT DATABASE
10.1. MedLeech acknowledges and agrees that it owns all data received from centers in the student database created by MedLeech (the "Student Database") and that all intellectual property rights in the Student Database are the property of MedLeech.
11. CONFIDENTIALITY
11.1. MedLeech treats all confidential information as strictly confidential and takes all reasonable steps to maintain its confidentiality and ensure its confidentiality by Center personnel;
11.2. Report any suspected confidentiality breaches to MedLeech promptly;
11.3. Cooperate with MedLeech in investigating such suspected breaches.
12. RECORDS STORAGE
12.1. MedLeech maintains all Student records and achievement information in an accurate, timely, and secure manner.
